Event Catering Houston, LLC provides our services to you subject to the following notices, terms, and conditions, our Privacy Policy and your order details (together, our Agreement). When you use any such service or fulfill or deliver any orders originated at or facilitated by Event Catering Houston, LLC, you are subject to all governing state and federal laws, and all applicable rules, policies, terms, and conditions. In this Agreement, Event Catering Houston, LLC, we, us, and our all refer to Event Catering Houston, LLC.
AGREEMENT WITH TERMS
By using this website or mobile application or working with our employees or agents by any means (including telephone, text, email, chat, in-person, or any other mechanism), you accept our Agreement. We reserve the right to make changes to our websites, our mobile applications, our services, and the Agreement at any time. Your use of our services or working with our employees or agents after any changes have been made constitutes acceptance of the changes.
ABOUT EVENT CATERING HOUSTON, LLC
Event Catering Houston, LLC is a one stop shop for your catering needs. We are a team of experienced event and menu planners for breakfast, lunch, dinner, ice cream socials and dessert bars for our clients.
ORDER POLICY
Due to the time it takes to prepare food orders, orders should ideally be confirmed seven days prior to service. We can provide service on shorter notice but to ensure availability on your preferred day, please reserve and confirm as early as possible. Please note that some menu selections may require additional notice or a substitution may be required.
CANCELLATIONS: We understand that things change and will do our best to accommodate changes. If staff has already been scheduled or special menu items ordered, there may be cancellation or rescheduling charges.
PRICE CHANGES
All prices on our menus and website are subject to change without notice.
SERVICE FEE
Service fees depend on the service level requested and may fluctuate based on staffing, distance to service location and complexity of service.
SALES TAX
The State of Texas requires sales tax to be applied to all service charges, hot and cold food, carbonated drinks and or events with serving staff. Sales tax is applied to all labor, rentals, and administration fees. Tax exempt organizations must provide documentation to retain on file.
PAYMENT TERMS
All events are required to be paid in full 10 days prior to your event. Corporate Account terms are Net 30 days. Any past due balances shall accrue at an annual interest at a rate of 10%. Past due accounts over 45 days will not be able to order until the account is brought current with exceptions granted on a case by case basis.

We accept ACH, Credit Card and Checks as payment. All checks should be made payable to Event Catering Houston, LLC and mailed to 12335 Kingsride Ln. #114, Houston, TX 77024.

COLLECTIONS
Clients will be responsible to pay all expenses and reasonable attorney's fees associated with any action brought to recover unpaid contract fees due to Event Catering Houston, LLC.
GRATUITIES
Although gratuities are not automatically included in your invoice and are not required, they are very much appreciated by the staff. You may add a gratuity by contacting your sales manager directly.
CERTIFICATES OF INSURANCE
Certificates of insurance are available upon request. Please provide a sample COI with the beneficiary’s legal name.
BREAKAGE/LOSS/LIABILITY
Client assumes full responsibility for any damage or loss of any equipment, including but not limited to tents, tables, chairs, linens, glassware, décor, China or flatware. Any lost, stolen or damaged equipment will be charged to the client at replacement cost. Event Catering Houston, LLC does not accept responsibility due to negligence by the client or any attendees of the client’s event that causes any damage as a result.
LEFTOVER FOOD POLICY
To ensure the safety of our clients and their guests, it is Event Catering Houston, LLC policy to remove and discard any leftover food after the event. Any uneaten or non-consumed food or bottled beverages left on the buffet table/food station area may be given to the client upon request. We do not recommend serving leftover food as we cannot ensure the safety in doing so, however, upon client request the above described leftover food and beverage may be taken by the client. The client will assume full responsibility and liability for the result any leftover food served and consumed, with or without Event Catering Houston, LLC’s knowledge.
DAMAGE WAIVER
Event Catering Houston, LLC will not be responsible for any damage to water lines, electrical lines, landscaping, buildings or patio flooring due to rust stains, scraps or scratches.
USE OF WEBSITE, COPYRIGHT AND TRADEMARKS
This website or mobile application is the sole property of Event Catering Houston, LLC and is protected by U.S. and international copyright laws. The compilation (meaning the collection, arrangement, and assembly) of all content on this website or mobile application, the content, and all software used on this website or mobile application, are the exclusive property of Event Catering Houston, LLC and are protected by U.S. and international copyright laws. Title to any part of this property shall not pass to you or to any other person or entity.
This website, mobile application, compilation, content and software may only be used as a personal e-commerce resource. Event Catering Houston, LLC reserve the right to refuse service, terminate accounts, and/or modify or cancel orders at our discretion, for any cause or without cause.
OWNERSHIPS OF INFORMATION
If you post names of, reviews of, or comments on products or companies on Event Catering Houston, LLC’s websites or mobile applications, you grant Event Catering Houston, LLC a non-exclusive, royalty-free, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such names, reviews, and comments throughout the world in any media. You also grant Event Catering Houston, LLC the right to use the name (if any) that you submit with any name, review, or comment in connection with such name, review, or comment.
GUARANTEE
Should there be errors, Event Catering Houston, LLC will offer every reasonable assistance in the correction of that error. In any event, however, the risk of loss and title for such items pass to you upon delivery or start of the catering service.
USING EVENT CATERING HOUSTON, LLC
You may only create and hold one account for your personal use (an “Account”). You may have another account if you are using the Site as part of a corporate account created for business purposes pursuant to a separate agreement with Event Catering Houston, LLC. In consideration of the use of the Site and the services contained therein, you agree that you are able to create a binding legal obligation with Event Catering Houston, LLC, and you also agree to: (a) provide true, accurate, current, and complete information about yourself, and (b) maintain and promptly update the personal information you provide to keep it true, accurate, current, and complete.
The Sites may permit you to make purchases without an Account or without logging in to your Account. If you make a purchase in this manner, we may create an Account for you based on the information provide to us in connection with the transaction (e.g., your name, phone number, email address, and other transaction information). If you are a minor in the jurisdiction in which you reside (generally under the age of 18), you must have the permission of, and be directly supervised by, your parent or legal guardian to use the Sites, and your parent or legal guardian must read and agree to this Agreement prior to your using the Sites. Notwithstanding the foregoing, you are not authorized to use the Sites if you are under the age of eighteen. If you are using the Sites on behalf of an entity, organization, or company, you represent and warrant that you have the authority to bind that organization to this Agreement and you agree to be bound by this Agreement on behalf of that organization.
If you provide any information that is untrue, inaccurate, not current or incomplete, including, without limitation, having an invalid or expired payment method on file, or if Event Catering Houston, LLC has reasonable grounds to suspect that any information you provide is untrue, inaccurate, not current or incomplete, Event Catering Houston, LLC has the right to block your current or future use of the Site (or any portion thereof) and/or terminate this Agreement with you. If your Account is cancelled for any or no reason or has been inactive for one year you may forfeit any pending, current, or future account credits or promotional offers and any other forms of unredeemed value in or associated with your Account without prior notice to you.
You are responsible for maintaining the confidentiality and security of your Account including your password. You are also responsible for all activities or any other actions that occur under or that are taken in connection with your Account. You agree to: (a) immediately notify Event Catering Houston, LLC of any known or suspected unauthorized use(s) of your password or Account, or any known or suspected breach of security, including, without limitation, loss, theft, or unauthorized disclosure of your password or credit card information; and (b) ensure that you exit from your Account at the end of each session. Event Catering Houston, LLC will not be liable for any injury, loss, or damage of any kind arising from or relating to your failure to comply with (a) and/or (b) or for any acts or omissions by you or someone else who is using your Account and/or password.
PAYMENT AND OUR CREDIT CARD POLICY
Certain features of the Sites, including, without limitation, the placing of orders, may require you to make certain payments. When paid by you, these payments are final and non-refundable, unless otherwise determined by Event Catering Houston, LLC. Event Catering Houston, LLC, in its sole discretion, may offer credits or refunds on a case-by-case basis including, by way of example, in the event of an error with your order or in the amounts you were charged.
Event Catering Houston, LLC will charge, and you authorize Event Catering Houston, LLC to charge, the payment method you specify at the time of purchase. If you pay any amounts with a credit card, Event Catering Houston, LLC may seek pre-authorization of your credit card account prior to your purchase to verify that the credit card is valid and has credit available for your intended purchase. In the event Event Catering Houston, LLC advances payment for any of your orders placed via the Sites (e.g., if you sign up for an Event Catering Houston, LLC House Account), Event Catering Houston, LLC may separately send you invoices for payment of those advanced amounts. In the event that you fail to pay such invoices within thirty (30) days of the date of such invoice (the “Payment Due Date”), you grant Event Catering Houston, LLC the right, but not the obligation, to charge the credit card you provide with your Account at any time after any Payment Due Date, unless prohibited by law.
Event Catering Houston, LLC reserves the right to establish, remove, and/or revise prices, fees, and/or surcharges for any or all services or goods obtained through the use of the services at any time. Event Catering Houston, LLC may also, in its sole discretion, make promotional offers with different features and different rates to any or all of our customers. Unless made to you, these promotional offers will have no bearing on your obligation to pay the amounts charged.
INDEMNIFICATION
You, your employer (if any), and any individual or company (if any) for whom you are a contractor, agree to indemnify and hold Event Catering Houston, LLC, officers, agents, and employees harmless from any loss, liability, damage, claim, or demand, including reasonable attorneys' fees, made by any party due to or arising out of (a) your use of this website or mobile application or any Event Catering Houston, LLC services in any way, (b) your fulfillment or attempted fulfillment of any orders sent to you or facilitated by Event Catering Houston, LLC, (c) your delivery or attempted delivery of any orders sent to you or facilitated by Event Catering Houston, LLC, whether sent to you directly or indirectly by Event Catering Houston, LLC, or (d) any other engagement or attempted engagement with Event Catering Houston, LLC.

EVENT CATERING HOUSTON, LLC AND THIS WEBSITE OR MOBILE APPLICATION ARE PROVIDED BY EVENT CATERING HOUSTON, LLC ON AN "AS IS" BASIS. EVENT CATERING HOUSTON, LLC MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS WEBSITE OR MOBILE APPLICATION OR THE INFORMATION, CONTENT, MATERIALS, SOFTWARE, OR PRODUCTS INCLUDED IN THIS WEBSITE OR MOBILE APPLICATION OR CONVEYED IN EVENT CATERING HOUSTON, LLC. Event Catering Houston, LLC disclaims any and all liability for the acts, omissions, and conduct of any users, food sources, delivery companies, third-party users, Event Catering Houston, LLC users, advertisers and sponsors on the websites or mobile applications, and all and any other third parties, in connection with the websites or mobile applications or Event Catering Houston, LLC, or otherwise related to use of the websites or mobile applications or Event Catering Houston, LLC. Event Catering Houston, LLC is not responsible for the products, services, actions, or failure to act of any third party. NO AGENCY RELATIONSHIP
You agree that Event Catering Houston, LLC is not responsible for any information you convey, in any manner, and that we have no control over any actions you take or statements you make. You agree that you and Event Catering Houston, LLC are independent contractors, and that neither you nor we are in any way an agent for the other party.
CHILDREN

GOVERNING LAWS
You acknowledge and agree that your access to and/or use of the Site, the Materials, and other content on the Sites is subject to all applicable international, federal, state, and local laws and regulations.
